Filming Release

For clients who appear in our footage: riders trying horses, buyers at the yard, and anyone on camera in a sales video, a social clip, a podcast episode or a website page. One form covers the person and the horse.

1 Who is being filmed

One form covers everyone on camera that day. Add a person for each rider, owner or agent who will appear — each of them signs below and each gets their own copy.

Person 1

In this form, you means each person named above and we means Horses Smith Ltd.

2 The horse or horses

Complete only for horses you own or are responsible for. Horses owned by Horses Smith do not need to be listed.

By signing, you confirm that you own each horse listed, or that you have the owner's authority to give the permissions in this form on their behalf. If you are not the owner and cannot get their authority, tell us before filming and we will keep that horse out of shot.

3 The filming

The Material means everything we record on those dates: video, audio, stills, and anything made from them, including edits, stills pulled from video, subtitles and translations.

4 What you are agreeing to

You give Horses Smith Ltd permission to record, keep, edit and use the Material, including your appearance, your voice, your name and any horse listed in section 2.

  1. Where we can use it. Our website, our own social media accounts, YouTube, the Yard Notes podcast, email to buyers and enquirers, sales listings and third-party sales platforms, printed material, and press or media coverage about Horses Smith.
  2. Where in the world. Anywhere. Our buyers are in the United States, Europe, the Middle East and Asia, and the internet does not respect borders.
  3. For how long. Indefinitely, unless you ask us to stop under section 6.
  4. Editing. We can cut, shorten, caption, subtitle, add music, and combine the Material with other footage.
  5. Payment. None is due either way. You are not paying us to film and we are not paying you to appear.
  6. Approval. You are not agreeing to approve the finished edit before it goes out — unless you ask for it here:
  7. Ownership. The Material belongs to Horses Smith Ltd. You keep every right you have in yourself and in your horse; you are giving us permission to use them, not handing them over.
5 What we will not do

These are limits on us, and they are part of the agreement.

  1. We will not sell or license the Material to another company for their own advertising.
  2. We will not use it in a way that suggests you endorse a product, a service or a third party, unless you agree separately in writing.
  3. We will not edit it to make you or your riding look incompetent, or to hold you up to ridicule.
  4. We will not publish your address, telephone number or email address.
  5. We will not attach your name to footage of a horse we are describing as having a problem, unless you have agreed to it.
  6. We will not use footage of a horse you have listed in section 2 to advertise that horse for sale by anyone other than you, unless you ask us to.

If you are not happy with something we have published, tell us and we will look at it. Section 6 sets out what we will do.

6 Your data

Footage of you is personal data, so UK GDPR applies. Horses Smith Ltd is the data controller.

What we hold
Your name and contact details from section 1, this signed form, and the Material itself.
Why we may use it
Our legitimate interests in marketing our own horses and our own business. You can object at any time, and section 6.1 says what happens then.
How long
Contact details for as long as you are a client and for six years afterwards. Published Material stays up until you ask us to take it down.
Who sees it
Our website host, our email provider, the social platforms we post to, and anyone in the world who can then see those posts. We do not sell your data.
Your rights
You can ask for a copy of what we hold, ask us to correct it, ask us to delete it, and object to our using it. Email harriet@horsessmith.com. If we get it wrong you can complain to the Information Commissioner's Office at ico.org.uk.

6.1 Asking us to take something down

You can ask us to stop using the Material at any time, in writing, for any reason or none. Then:

  • We will take it off our website, our own social accounts and our own channels within 14 days.
  • We will stop using it in anything new from the day you ask.
  • We cannot recall copies already printed, already downloaded by someone else, or reposted by third parties, and we cannot pull it back out of a buyer's inbox. We will tell you honestly what we cannot reach.
7 Under 18s

If the person being filmed is under 18, a parent or guardian signs instead of them, in section 9. Two extra rules apply, and they are not negotiable:

  1. We will not publish a child's full name, their yard, their school, their competition entries or anything else that would let a stranger find them. A first name only, or no name.
  2. Either the child or the parent can ask us to take the footage down at any time up to the child's 19th birthday, and we will, in full, without asking why.

The same applies to any adult who has someone acting for them under a power of attorney or a deputyship.

8 General
  1. This form is the whole agreement about filming and replaces anything said beforehand.
  2. It is governed by the law of England and Wales, and the courts of England and Wales deal with any dispute.
  3. If any part of it is found to be unenforceable, the rest still stands.
  4. Nothing here limits our liability for death or personal injury caused by our negligence, or for fraud.
  5. Filming does not change anything about a horse sale. Nothing said or shown on camera is a warranty about a horse, and a sale is governed by its own contract.
